Private body details
PM & Co Inc. Attorneys is a private body for purposes of the Promotion of Access to Information Act 2 of 2000. Records
Subject to professional confidentiality, legal privilege, retention requirements and applicable grounds of refusal, the firm may hold corporate and governance records; personnel records; client, matter and mandate records; supplier and procurement records; financial, tax and accounting records; policies and compliance records; information-technology and security records; intellectual-property and marketing records; and records required under legislation applicable to the firm.
How to make a request
Use the prescribed PAIA Form 2 available from the Information Regulator’s PAIA forms page. Identify the requested record clearly, state the form in which access is required, provide proof of identity and contact details, and explain the right you seek to exercise or protect and why the record is required for that purpose. Send the completed request to the contact details above and retain a copy.
Fees and decision
Any prescribed request or access fee will be communicated before the request is processed where applicable. The firm will decide a valid request within the period prescribed by PAIA, subject to a lawful extension, and will give notice of the outcome and any fees. Access may be refused where PAIA requires or permits refusal, including protection of privacy, confidential information, privileged material, safety, commercial information or records protected by law.
Voluntary and automatically available information
Public website pages, published contact details and other material expressly made available by the firm may be accessed without a PAIA request. A request for client or matter information is not automatically available and remains subject to confidentiality, privilege, authority and applicable law.
Further guidance and complaints
The Information Regulator publishes a PAIA guide, templates and procedures. If a request is refused or not answered, the requester may use the remedies available under PAIA, including a complaint to the Information Regulator or an application to a competent court, subject to applicable requirements and time periods.
